Abstract

En la doctrina se advierte que la fundamentación de la responsabilidad del Estado se apoya en diversos institutos. Sólida doctrina se apoya en el Estado de Derecho para justificar la posibilidad de que el Estado responda. Empero, cuando el Estado de Derecho deviene insustancial o reñido con la realidad normativa o la jurisprudencia actual, es menester apelar a otro fundamento. Este otro fundamento, en tanto compatible con el Estado de Derecho, puede brindar bases más sólidas y permanentes para fundar la responsabilidad del Estado. Tal el caso de la justicia.
