Corte Constitucional da Colômbia e os direitos dos casais homossexuais: um passo de cada vez?

A Corte Constitucional colombiana é uma das cortes mais ativistas do mundo em matéria de direitos fundamentais. Não obstante, no tocante ao reconhecimento dos direitos de casais homossexuais, a Corte tem sido mais autocontida, realizando uma jurisprudência que pode ser caracterizada apenas como gradualmente progressista. Fatores como a oposição de movimentos religiosos e a ausência de uma opinião pública mais favorável podem explicar esse comportamento menos ativista comparado ao padrão adjudicatório da Corte.
