Normative improvement and regulatory governance in Colombia: characterization, model design flaws and risks to policy implementation

The purpose of this article is to compare the design of the regulatory governance model adopted by the Colombian State from the formulation of its policy of regulatory improvement with the recommendations made by the OECD and the experience of its application in some of its member countries in order to establish if there are flaws in its design and to identify risks that could negatively affect its implementation. To this end, the article is divided into three parts: the first presents the background and the establishment of policies for better regulation and the design of regulatory governance to implement them, with emphasis on the model proposed by the OECD; the second part presents the background to the adoption of the policy of regulatory improvement by the Government of Colombia, which defines the stages that make up the cycle of regulatory governance; the third part presents the results of the comparison of the Colombian regulatory governance model with the recommendations of the OECD and the experiences of Spain, France and Mexico, identifying the flaws in the design of the model and the risks to achieve a successful implementation of the policy of regulatory improvement.
