Legal Protection of Archaeological and Underwater Heritage in Spain

This study analyzes the legal framework governing archaeological and underwater heritage within the Spanish legal system, with a particular focus on its classification as cultural public domain and on the administrative powers designed to ensure its protection and conservation. Based on a study of the Spanish Constitution, the Spanish Historical Heritage Act, and Catalan regional regulations, the paper examines the evolution of a model of public guardianship characterized by the automatic transfer of archaeological finds to public ownership, the displacement of traditional categories of civil law, and the intensification of administrative control over archaeological activities. Likewise, the study analyzes the main conflicts arising from this system, particularly in relation to property rights and the freedom of scientific research. In the field of underwater heritage, the study addresses the difficulties stemming from the jurisdictional fragmentation of the law of the sea and the existing conflicts between cultural protection and the economic exploitation of historic shipwrecks. Finally, the study highlights the need to strengthen mechanisms for international cooperation and to consolidate a comprehensive protection model focused primarily on preserving the historical and scientific value of archaeological heritage.
