A Administração Pública tem o dever prioritário de proteger os direitos constitucionais. Tal dever supõe ampliação do autocontrole, respeito às decisões judiciais consolidadas e favorece a afirmação do princípio da deferência. A tarefa de evitar a ação ou omissão inconstitucional é de todos os agentes de Estado e, de acordo com as suas atribuições, representa aspecto crítico do novo Direito Administrativo. Por outras palavras, a constitucionalidade — além da conformidade com as regras legais — precisa ser assegurada e garantida pelo Estado inteiro, incluída a Administração Pública.
