Após os ataques terroristas de 11 de setembro de 2001, promovidospela Al-Qaeda, o debate no constitucionalismo norte-americano tem como
foco central a segurança nacional e os limites às liberdades civis. A doutrina
da Constituição de Emergência de Bruce Ackerman é analisada neste
texto sob a ótica das críticas formuladas pelo constitucionalista norte-
americano David Cole. Nas conclusões, acrescentamos nosso ponto de vista.
