Abstract

Consultam-nos os ilustres Vereadores de Curitiba Jorge Samek e Ney Leprevost a respeito da constitucionalidade das Proposições nº 01.00001.2001 e nº 11.00001.2001, ambas datadas de 18 de abril p.p. e que buscam introduzir a regra do voto aberto no processo legislativo da Câmara Municipal local. A Proposição nº 01.00001.2001 altera a redação dos arts. 35 e 47, § 1º, da Lei Orgânica do Município de Curitiba, enquanto a Proposição nº 11.00001.2001 altera a redação do art. 13, § 5º, revoga o inciso IV do § 2º do art. 132 e altera a redação do § 6º, todos do Regimento Interno da Câmara Municipal de Curitiba, objeto da Reso lução nº 04, de 28 de junho de 1990.
A resposta à consulta envolve o exame preliminar de alguns dispositivos
da Consti tuição Federal de 1988 (CF/88), atinentes aos seus princípios fundamentais e à posição do Município na Federação, após o que se passará em revista específica das proposições legislativas em tela.
