Abstract

Este artículo resume las características de los métodos de comparación constitucional, que prevalecen en el estudio de los fenómenos de globalización y derecho transnacional.  La comparación de "casos" y "problemas", fundada sobre "dialogue" y "cross-fertilization", sin discutir de las "causas" de las diferencias en la fragmentación de los espacios jurídicos, produce una actitud intelectual de "praesumptio similitudinis" y de "talcualismo", que el autor define comparación "ad hoc", porque funcional a las condiciones geopolíticas y económicas preconcebidas y por ello perjudicial en la educación crítica del jurista global.
