Constitutional dialogues and legislative omission in an empirical perspective: interactions between the Federal Supreme Court and the National Congress regarding the unconstitutional legislative delay from 1988 to 2023

This article examines the constitutional dialogues between the Federal Supreme Court (STF) and the National Congress (CN) regarding unconstitutional legislative omissions, based on rulings from 1988 to 2023. It utilizes theories of constitutional dialogue to analyze interactions aimed at addressing unconstitutionality through injunctions (MI) and direct actions for unconstitutionality by omission (ADO). Employing quantitative and qualitative methodologies, the study presents exploratory-descriptive analyses of the data. The findings reveal that in 51% of cases, the CN did not remedy the omissions identified by the STF. The analysis further shows that declaring legislative delays is more effective than techniques urging legislator action with deadlines or intermediate normative rulings, the latter of which supports immediate constitutional applicability. Among cases where omissions were remedied, 47% were initiated by mere declarations of delay. In contrast, 65% of cases where omissions remained unaddressed involved intermediate rulings. Ultimately, the study concludes that dialogic mechanisms for addressing legislative omissions demonstrate a relatively high level of effectiveness.
