How can self-government help the microsystem of data protection for the control of state actions?

This article aims to analyze how self-government can be useful in the treatment of personal data by the State. As such, it proposes the coexistence of the heteronomy of judicial control with the improvement of non-judicial checks and balances that can mitigate risks in this field. It defines the microsystem of personal data protection as the set of rules aimed at regulating the processing of personal data: rights, obligations and prerogatives; and guarantees (individual and structural). It considers that this microsystem must combine legal regulation of fair rights along with guarantees to make them effective. It considers the occurrence of a hegemonic authority when this issue is either fully self-regulated (it obeys rules produced predominantly interna corporis) or immune to diffuse and concentrated controls in its actions and functionalities. Based on these premises, it proposes the following essential characteristics of the microsystem of personal data protection: existence of statutes, preferably heteronomous, with clear norms on the elements of “who”, “when” and “how” it is possible for the State to deal with or regulate personal data; adoption of dialogic practices and justification methodologies in the processes of producing norms, defining systems designs and algorithm metrics that impact the treatment of personal data by the Government; structural engineering of public institutions responsible for processing personal data, providing for reciprocal inspection of concentrated control + defense guarantee methodologies; increased transparency in analyses of compliance carried out in data processing by the Government (protecting the confidentiality of personal data), and also the implementing of risk management methodologies and of rules for designing systems that contain premises and filters to protect personal data.
