Intent and guilt in administrative infractions: a review

The article, through the hypothetical-deductive and inductive methods, investigates the subjective element of administrative infractions. The hypothesis for testing was the proposition that administrative infractions would only be configured by intent when there was no express legal provision on the subjective element required. The subjective element in criminal, civil and tax offenses was analyzed. A classification of administrative offences has been formulated. Three propositions of other authors were tested. It is concluded that the hypothesis was not confirmed, but it was possible to establish other general propositions, in addition to guiding the solution of some cases.
